Domestic package tours: Tour Conditions

(Explanation of Tour Conditions pursuant to Article 12-4 of the Travel Agency Law)
(Contract document pursuant to Article 12-5 of the Travel Agency Law)

1. Domestic package tours Tour Conditions
(1)

This trip is planned, advertised and implemented by Club Tourism Co., Ltd. (hereinafter referred to as "our company").

(2)

Tour Conditions are based on the conditions below as well as the conditions listed for each course, the brochure (travel guide), the confirmation document, and our travel agency terms and conditions (section on package tour contracts). If you would like a copy of our travel agency terms and conditions, please request one from us. Our travel agency terms and conditions can be viewed on our website at https://www.club-t.com/ct/information/function/covenant/yakkan/01_bosyuu/.

2. Travel application and conclusion of contract
(1)

We accept reservations for travel contracts via telephone, mail, facsimile, the Internet (please apply through our website) Other means of communication.

(2)

The full travel fee must be paid no later than 21 days (11 days for day trips) prior to the start of the trip.

(3)

Children under the age of 15 must be accompanied by a guardian. If a child between the ages of 15 and 18 is participating alone, a parental consent form is required, so please let us know.

(4)

A travel contract is concluded when our company accepts the conclusion of the contract and accepts a partial or full payment of the travel fee. In addition, when our company accepts a partial or full payment of the travel fee from the representative (hereinafter referred to as the "contract representative") of the travelers who make up the group or organization (hereinafter referred to as the "members"), the travel contract is considered to have been concluded for all members of the group. However, this does not include cases where you have requested that each participant pay separately at the time of application.

  • We accept applications for travel contracts from card members (hereinafter referred to as "members") of credit card companies affiliated with our company (hereinafter referred to as "affiliated companies") on the condition that payment of the application fee or full travel fare can be received by card without the member's signature on the designated slip (hereinafter referred to as "correspondence contract"). In such cases, the contract is concluded when the member is notified that our company accepts the conclusion of the contract. However, there are cases where we are unable to accept the contract due to reasons such as not having an affiliation contract with an affiliated company that includes a special clause for handling without signatures, or for business reasons.
  • When applying for a Communications Contract, the Member will need to provide the Company with the "name of the package tour" and "departure date" for which they are applying, as well as the "card name," "membership number," "card expiration date," etc.
  • The "Card Use Date" in the Communications Contract is the date on which the Member and the Company must make payment or refund any debts, such as the travel fare, under the Travel Contract. In the former case, this is the date on which the contract is concluded, and in the latter case, this is the date on which the request to cancel the contract is made.
  • If the travel you have applied for Full or we are unable to enter into a travel contract for Other reasons, and you specifically request it, we may treat the travel contract as being concluded when we are in a position to conclude it with you. The travel contract is considered to be concluded when we receive a notice from you stating that we have accepted the conclusion of the travel contract.
  • Reservations made for the purpose of resale by travel agencies or corporations that do not have a contract with us are not permitted. Reservations made under false names are also not permitted.

For trips that specify special conditions for participation, we may refuse your application if the participants' gender, age, qualifications, skills Other conditions do not meet the conditions specified by our company.

(6)

If you are in poor health, use a wheelchair or other device, have a physical or mental disability, have severe allergies, are pregnant or may be pregnant, are accompanied by an assistance dog for the physically disabled (guide dog, hearing dog, service dog), or require Other special consideration, please inform us at the time of application that you require special consideration in order to participate (if you become ill after the travel contract has been concluded, please inform us immediately). We will provide you with further information, so please inform us of the specific measures you will require during the trip.
If we receive your request, we will respond to it to the extent possible and reasonable. In doing so, we may ask you to explain your situation and the measures you require, or ask you to provide them in writing.

(7)

In order to ensure the safety and smooth operation of the trip, we may impose conditions such as the accompaniment of a caregiver or companion, the submission of a medical certificate from a doctor, and changes to part of the course. Furthermore, if we are unable to arrange the measures requested by the customer, we may refuse the application for a travel contract or cancel the travel contract. In principle, the cost of special measures taken by our company for the customer based on the customer's request shall be borne by the customer.

(8)

If the travel schedule, Accommodation, and name of the transportation company cannot be confirmed at the time of application, we will send you a confirmation document stating the determined details by the day before the start of the trip. However, if the application is made 7 days or less before the start of the trip, we may hand it over on the day of the start of the trip. However, if you have any inquiries before the deadline, we will explain the status of the arrangements.

We are not compliant with the EU General Data Protection Regulation (GDPR) or the UK General Data Protection Regulation (UK GDPR), and therefore cannot accept applications from residents of the EEA (EU27 + Iceland, Norway, Liechtenstein) or the UK.

3. What is included in the tour price

Expenses for transportation, Accommodation, meals, sightseeing, etc., as specified in the travel itinerary, as well as various taxes such as consumption tax.

  • The above fees will not be refunded even if some of the services are not used due to customer's convenience.
  • Meals, bedding and train seats are not provided for infants.
4. Items not included in the tour price

Transportation costs, meal costs, entrance fees, personal expenses during the trip (telephone calls, dry cleaning, drinks, etc.), and optional tour costs for sections of the itinerary marked as "free time," "free sightseeing," "additional charge," "at your own expense," etc.

5. Changes to travel contract details and travel prices

Our company may change the contents of the contract in the event of natural disasters, war, riots, suspension of services such as transportation and Accommodation facilities, orders from government agencies, provision of transportation services not in accordance with the original operation plan, Other events beyond our control. In addition, we may change the tour price in conjunction with such changes. Furthermore, we may change the tour price if the fares and charges of the transportation facilities used are revised significantly beyond the normally expected level due to significant changes in the economic situation. In the event of an increase, we will notify you no later than Day 5 the day before the start of the trip.

6. Replacement of Customers

You may transfer your contractual status to a third party with our consent. In this case, you will be required to pay the costs of the transfer.

7. Cancellation of the travel contract and refund by the customer before the trip begins

  • The time of cancellation shall be based on the time that a participant notifies us of it within our business days or hours.

  • Overnight day trip" shall be treated as "Day trip.

  • If you use airline tickets sold widely to consumers via websites, etc., if you use airline tickets set by airlines, or if you use a chartered ship, the cancellation fees may differ from those stated above. Please be sure to check the details in the contract document.

  • "Bus Tour" refers to trips where the primary mode of transportation is by bus.

In the following cases, you may cancel the Travel Contract before the start of the trip without paying the cancellation fee. In such cases, we will refund the full amount of the travel fare already paid within 7 days from the day following the cancellation date.

When the contents of the contract are changed. However, such changes are limited to major changes covered by the Itinerary Guarantee that fall under "Changes that require the payment of change compensation" pursuant to the provisions of Article 14.

8. Cancellation of the Travel Contract and Refund by Us Before the Start of the Trip
(1)

If you fail to pay the travel fee by the due date specified by our company, we may cancel the travel contract. In this case, you will be required to pay a penalty equivalent to the cancellation fee set out in the preceding paragraph.

(2)

If the number of customers does not reach Minimum Number of Participants, the trip may be canceled. In this case, we will notify you of this at least 14 days before the start of the trip (4 days for day trips), refund the full amount of the trip fee that you have already paid, and cancel the travel contract.

9. Cancellation of Travel Contract and Refund after Travel Has Commenced

If you leave the tour midway for personal reasons, this will be considered a waiver of your rights and no refunds will be given.

If the travel services cannot be provided according to the final itinerary due to reasons beyond the customer's control, the customer may cancel the relevant portion of the contract. In that case, we will refund the relevant portion of the travel fee to the customer. However, if the reason is beyond the customer's control, we will refund the amount after deducting the cancellation fee, penalty fee, Other expenses already paid or to be paid for the relevant portion.

(2)

Termination and Refunds by Us
We may cancel the Travel Contract in the following cases. In such cases, we will refund to you within 30 days counting from the day following the end of the trip the portion of the travel fee relating to the travel services not provided to you minus the cancellation fee, penalty fee Other other expenses already paid or to be paid in the future for that portion.

10. Group contracts
(1)

When a travel application is received from a contract representative of an organization or group, we will assume that the contract representative has all authority to enter into and terminate the contract, and will proceed with the contractual transaction accordingly.

(2)

The contracting officer must submit a list of members to the Company by the date specified by the Company.

(3)

The Company shall not be liable for any debts or obligations that the Contracting Person currently owes or is expected to owe in the future to any Member.

(4)

If the Contracting Person does not accompany the party or group, after the commencement of the trip, we will deem a member selected in advance by the Contracting Person to be the Contracting Person.

11. Our Liability
(1)

In the course of carrying out the travel contract, if the Company or its agent causes damage to the customer through its intention or negligence, the Company shall be liable to compensate the customer for the damage suffered, provided, however, that the Company is notified within two years from the day following the occurrence of the damage.

(2)

Regarding damage to luggage, we will only compensate you up to 150,000 yen per person (except in cases where the damage is due to our willful intent or gross negligence) if you notify us within 14 days from the day after the damage occurred.

12. Your Responsibilities
(1)

If the Company incurs damage due to the customer's intentional or negligent acts, the customer will be required to compensate for the damage.

(2)

You must use the information provided by us to ensure that you understand the traveler's rights and obligations as set out in the contract documents and Other contents of the travel contract.

(3)

If, after the commencement of the trip, the client realizes that the travel services provided differ from those described in the contract document, the client must promptly notify us or the travel service provider at the destination.

(4)

If a customer becomes injured Other ill during the trip and requires medical treatment or Other measures, the customer must follow the instructions of the Company in order to ensure the smooth running of the trip. The cost of such treatment must be borne by the customer.

13. Special Compensation

Regardless of whether or not our company is responsible, in accordance with the special compensation provisions of our travel agency contract, we will pay a predetermined amount of compensation for death, compensation for permanent disability, condolence money for hospitalization, condolence money for medical visits, and compensation for damage to baggage for certain damage suffered by a customer to his/her life, body, or baggage due to an accidental and sudden external injury accident while participating in the trip. However, this does not include the following cases.

Damage suffered by you on any day when no travel services arranged by us are provided

14. Itinerary Guarantee
(1)

In the event of any significant change to the contract contents listed in the "Changes requiring payment of a change compensation" in the table below, we will pay a change compensation equal to the travel price multiplied by the rate listed in the right column of the table within 30 days counting from the day following the end of the trip, except for the following changes that are not caused by overbooking despite the provision of transportation, Accommodation, or other services:

Changes due to the following reasons:
(a) Natural disasters; (b) War; (c) Riots; (d) Orders from public authorities; (e) Suspension of travel services provided by transportation and Accommodation providers; (f) Provision of transportation services not in accordance with the original operation plan; (g) Necessary measures to ensure the safety of the lives and bodies of travel participants.

B

Changes to the part of the travel contract that has been terminated in accordance with Articles 7, 8 and 9.

(2)

The amount of the change compensation payable by our company shall be limited to 15% of the travel price per person per trip. However, if the total amount per person is less than 1,000 yen, we will not pay the change compensation.

(3)

With your consent, we may substitute goods or travel services of equal or greater value for the payment of the Change Compensation.

(4)

If, after we have paid the change compensation pursuant to this paragraph, it becomes clear that we are responsible for the change pursuant to the provisions of paragraph 11, we will pay the difference between the damages that we should pay and the change compensation that we have already paid.

(Note 1)

"Before the start of the trip" means that the traveler is notified of the change by the day before the start of the trip, and "after the start of the trip" means that the traveler is notified of the change on or after the start of the trip.

(Note 2)

If a final document has been issued, "contract document" shall be read as "final document" and this table shall apply.
In this case, if any changes occur between the contents of the Contract Document and the contents of the Final Document, or between the contents of the Final Document and the contents of the Travel Services actually provided, each change will be treated as one change.

(Note 3)

Even if multiple changes as specified in items 3, 4, 6 or 7 occur within one boarding trip, ship ride, etc. or one overnight stay, each boarding trip, ship ride, etc. or one overnight stay will be treated as one change.

(Note 4)

The classification of Accommodation facilities referred to in item 6 shall be determined based on the list stated in the contract document at the time of conclusion of the travel contract or the list available for viewing at our sales offices or on our website.

(Note 5)

For the changes set forth in item 8, the rates in items 1 to 7 shall not apply and item 8 shall apply.

15. Prohibited Activities

Under the terms of their contract with the Company, Participants are prohibited from engaging in the following acts:

(1)

Any act that infringes or may infringe the copyright, property rights, privacy or Other rights of other participants, third parties, or our company.

(2)

Any other actions that cause or may cause disadvantage or damage to other participants, third parties, or our company.

(3)

Any act that slanders other participants, third parties, or our company.

(4)

Any act that violates or may violate public order and morals, or any act that provides information that violates public order and morals to other participants or third parties.

(5)

Any commercial activity or any activity intended to prepare for such activity through or in connection with a contract with the Company without the Company's consent.

(6)

Any act that violates or may violate laws and regulations.

(7)

Other conduct that the Company deems inappropriate.

16. Exclusion of Antisocial Forces
(1)

Participants represent to our company that they are not members of an organized crime group, have connections to an organized crime group, or are affiliated with any Other anti-social forces, and warrant that they will not be in that position in the future.

(2)

Participants agree to not engage in any of the following acts, either by themselves or through a third party:

Using threatening language or violence in relation to transactions.

Any act of spreading rumors, using fraudulent means or using force to damage the Company's credibility or interfere with the Company's business.

(3)

If the Participant violates or is reasonably suspected to violate the commitments under Paragraphs 1 and 2 of Article 16, the Company may immediately terminate the agreement with the Participant without requiring any notice Other procedures. Furthermore, the Company shall not be liable for any damages incurred by the Participant arising from or in connection with the termination.

17. Handling of Personal Information
(1)

We directly or indirectly obtain personal information provided by customers through applications and inquiries by telephone, mail, facsimile, internet Other means of communication, travel application forms, participation confirmations, questionnaires, product purchase applications for merchandise sales, etc., as well as Personal Information Personal Information such as our website browsing history, purchase history and behavioral history when using apps provided by our company, and retain some of this information as personal data, which will be used by our company, our group companies and contracted travel agents (sales outlets) for communication with customers, and will be used within the scope necessary for arranging services provided by transportation, Accommodation facilities, etc. for the trip you have applied for and for the procedures for receiving those services. When you apply, you will be required to consent to the provision of this personal data.

Of Personal Information of customers held by our company, we will share with our group companies the information such as addresses, names, telephone numbers, dates of birth, gender, product purchase history and email addresses for the purpose of product development, sales promotion activities such as product information, and for contacting and responding to customers.

(4)

In case you become injured or ill during your trip, we will ask you for Personal Information of your domestic contact during your trip. This Personal Information will be used if we deem it necessary to contact your domestic contact in the event that you become injured or ill. You will obtain the consent of your domestic contact to provide us with Personal Information of your domestic contact.

(5)

In addition to the above, please refer to our website for our company policy on handling Personal Information and the names of our group companies.

Guidance from application to departure

1. Application

From us to you
We will send you documents such as a "Transfer Form/Travel Details Sheet," "Pamphlet (Travel Guide)," and "Domestic Travel Insurance Application Form (optional)."

There are three ways to pay for your trip:

(1)

Transfer at a bank or post office
A special transfer slip will be sent to you.

(2)

Credit card (Club Tourism Card, VISA, MASTER, JCB, DC, AMEX, Diners, UFJ, NICOS)
Please apply by calling the Travel Center or complete the payment procedure online.
*For details about credit card payments via the Internet, please see "Payment via the Internet."

(3)

Automatic withdrawal from Japan Post Bank account
You can pay for your trip by automatic debit from your Japan Post Bank account.

  • If you wish to use automatic withdrawal from your Japan Post Bank account, you will need to register with Japan Post Bank in advance. For more information, please contact the Travel Center.
2. At least 3 weeks before the start of the trip

From our customers to us
Please transfer the travel fee (including the insurance fee if you have Domestic Travel insurance) at your nearest bank or post office at least 3 weeks before the start of the trip. If you apply less than 3 weeks before, please do so within 3 days of receiving the documents.

  • This does not apply to customers who choose "automatic deduction from a Japan Post Bank account."
  • This does not apply to customers who apply by credit card, as payment will be made by credit card.
3. 6 to 1 day before the trip start date

From us to you
We will send you a "confirmation document (travel guide)" by the day before the trip, which includes information on the meeting place on the day the trip starts, the hotel Accommodation, etc. However, if you apply within 7 days before the trip starts, we may give it to you on the day the trip starts.

  • For tours that depart and return by bus and plans where you meet directly at the location, we will only send you the documents once (except when the contents are undecided). Therefore, the "brochure" we sent you will serve as the "confirmed document."
4. On the day the trip begins

Please be sure to bring your "confirmation document (travel guide)" or "brochure (travel guide)" with you on the day.

  • This is a group tour, so please arrive with plenty of time to spare.

If you wish to change or cancel your application after it has been submitted, please contact us by phone.
In addition, cancellation fees will be charged for reductions in the number of participants or changes to the start date or course of a trip from 20 days prior to the start date of the trip (14 days prior for Accommodation bus trips and 10 days prior for day trips).

Regarding payment fees
Please note that payment fees will be borne by the customer. In addition, please note that payment fees cannot be refunded even if the tour price is refunded due to Canceled.

Notification of receipt of travel fees
We will not contact you regarding receipt of your travel fare.

About optional insurance
Please fill out the Domestic Travel insurance contract application form (optional), affix a stamp and return it to us. Please pay the insurance premium together with the travel fare. Please note that only contract applications with a postmark of 5 days or less before the start of the trip are valid.

Decision on whether to hold the event or not
If we are unable to meet the required number of participants due to the nature of group tours, we may have to cancel the tour. If we are forced to cancel the tour, we will contact you at least 14 days before the start of the tour (4 days before for day trips).

Resuming travel
We will not re-operate the trip under any circumstances.
